Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "Customer") and Broxy ("Broxy", "we", "us") regarding the proxy services available at broxy.ai (the "Service"). By creating an account or purchasing a proxy, you agree to these Terms.

1. The Service

Broxy resells dedicated residential proxy IPs sourced through licensed upstream providers. Each proxy you purchase is assigned to you for the duration of your billing period and may be used solely in accordance with these Terms and our Acceptable Use Policy("AUP").

4. Acceptable Use

Use of the Service is subject to our Acceptable Use Policy. Violations may result in immediate suspension or termination of your account without refund. You are solely responsible for the data you route through Broxy proxies and for complying with all applicable laws.

5. No Warranty; SLA

We target 99.9% uptime, but the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that any specific IP will work with any specific third-party site, or that proxy IPs will remain unblocked.

6. Limitation of Liability

To the fullest extent permitted by law, Broxy's total cumulative liability arising out of or related to the Service shall not exceed the amount you paid to Broxy in the 30 days preceding the event giving rise to the claim. In no event shall Broxy be liable for any indirect, incidental, consequential, special, or exemplary damages, including lost profits, even if advised of the possibility.

7. Indemnification

You agree to indemnify and hold harmless Broxy, its officers, employees, and upstream providers from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms or the AUP, or (c) your violation of any rights of a third party.

8. Suspension & Termination

We may suspend or terminate your access immediately, without notice, if we believe you have violated these Terms or the AUP, or if required by law or our upstream providers. Upon termination your right to use the Service stops immediately; provisions of these Terms that by their nature should survive will survive (e.g., Sections 5, 6, 7, 9, 10).

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Disputes shall be brought in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.

10. Changes

We may update these Terms from time to time. Material changes will be communicated by email or by posting an updated version with a new "Last updated" date. Continued use of the Service after a change constitutes acceptance.
